SE LE ADJUDIC\u00d3 UN INMUEBLE EN UN PROCEDIMIENTO EJECUTIVO INSTADO POR LA PROPIA COMUNIDAD<\/h2>\n

Hemos recibido una recent\u00edsima resoluci\u00f3n -de 12 de febrero de 2016-, todav\u00eda no publicada en el BOE, que admite la posibilidad de que una comunidad de propietarios pueda ser titular registral de dominio, a pesar de carecer de personalidad jur\u00eddica, apoy\u00e1ndose el Centro Directivo en la nueva redacci\u00f3n del art\u00edculo 9 de la Ley Hipotecaria<\/a>: …\u00bb\u00a0e) La persona natural o jur\u00eddica a cuyo favor se haga la inscripci\u00f3n o, cuando sea el caso, el patrimonio separado a cuyo favor deba practicarse aqu\u00e9lla, cuando \u00e9ste sea susceptible legalmente de ser titular de derechos u obligaciones<\/strong>.\u00bb<\/em><\/span><\/p>\n

Se admite la inscripci\u00f3n \u00abcon car\u00e1cter excepcional y transitorio\u00bb, derivada de adjudicaciones por embargos, hasta que se venda o se adjudique a los copropietarios o se convierta en elemento com\u00fan. Pero\u00a0la inscripci\u00f3n tiene duraci\u00f3n indefinida…, por lo que queda en el aire la situaci\u00f3n creada si pasa el tiempo y no se hace ninguna de las tres cosas.\u00a0<\/span><\/p>\n
